SEALED BID OFFERING – 627 MAXON STREET, WAUPUN, WI
Sealed bids will be received up to 11 am, on Friday, May 15, 2026, in the City of Waupun Clerk's Office, located at 201 E Main Street Waupun, for a City-owned parcel located at 627 Maxon St. Bids will be opened on May 18, 2026 at 10:00 am in the Common Council Chambers of Waupun City Hall, located at 201 E Main Street, Waupun, WI. Note: Legal descriptions may be abbreviated. Any maps of parcels provided by the City of Waupun are for illustration purposes only and may not accurately reflect the actual legal boundaries of a parcel.

LEGAL PROVISIONS
This offering and any resulting conveyance are subject to applicable Wisconsin Statutes and municipal ordinances, including but not limited to:
- Pursuant to § 709.01, Wisconsin Statutes, this transaction is exempt from the requirement to provide a Real Estate Condition Report. The Seller is a municipality and the Property is not owner-occupied residential real estate. Accordingly, no Real Estate Condition Report will be provided.
- Sales is conducted pursuant to Wis. Stat. § 62.22(1) and has been authorized by the Waupun Common Council.
- Final award and approval of sale shall occur at a properly noticed public meeting in compliance with Wis. Stat. § 19.81.
- Bidders are subject to Wis. Stat. § 19.59 and local ethics codes. Any potential conflict of interest must be disclosed.
ZONING AND LAND USE
The property is zoned R4 Residential. As outlined in Waupun Municipal Code 16.03, the R-4 District is intended to provide for single-family dwellings and two-family dwellings in areas of older subdivisions with smaller lot sizes. The District is also intended to provide an area protected from traffic hazards.. The City will not rezone the property as a condition of sale. Buyers are solely responsible for verifying permitted and conditional uses, dimensional requirements and development feasibility. The City makes no representation regarding suitability for any specific use.
SALE CONDITIONS – AS IS, WHERE IS
The property is being sold as-is, where-is, with all faults. The City of Waupun makes no warranties or representations, express or implied; disclaims all warranties, including but not limited to: Condition of the property, soil or subsurface conditions, environmental condition, utility capacity, buildability or fitness for a particular purpose. Buyer is responsible for all due diligence, including inspections, investigations, and testing.
SEALED BID REQUIREMENTS
- Submission Deadline: May 12, 2026, noon. Late or incomplete bids will not be considered.
- Method of Submission: Bids must be submitted in a sealed envelope, clearly marked “Sealed Bid – 627 Maxon St, Waupun, WI.”
- Deliver To: Sealed bids should be delivered to Waupun City Hall, Attention: Angie Hull, Clerk, 201 E Main St, Waupun, WI 53963.
- Required Content: Each bid must include the following:
- Bidder name, address, phone number and email
- Offered purchase price
- Proof of funds or financing commitment
- Intended use
- Signed bid form (attached)
- Minimum Bid Amount: $33,000. Bids below this amount will not be considered.
BID EVALUATION AND AWARD:
The City reserves the right to reject any and all bids, waive informalities or irregularities, request additional information from bidders, and accept the bid deemed in the best interest of the City. Bids are awarded based on the following criteria: (a) Dollar value; (b) Prospective use of property; (c) Prior ownership; (d) Adjacent property ownership; (e) Taxability of property upon transfer; (f) Build ability under present zoning codes; (g) Delinquent real estate taxes owed by bidder; and (h) any other criteria the Waupun Common Council wishes to consider to evaluate any bid.
Upon award, earnest money in the amount of 10% of the purchase price is required and must be submitted within 48 hours of acceptance of the bid. Earnest money must be in the form of a certified check payable to the City of Waupun.
PURCHASE TERMS:
The City of Waupun reserves the rights to reject any and all bids. The submission of any bid shall be contingent upon approval by the Waupun Common Council at a properly noticed public meeting. The City shall have no obligation to proceed with any sale unless and until such approval is granted. In the event approval is not granted, the City shall have no liability to the bidder. The City of Waupun anticipates closing within TEN (10) days of bid acceptance. The City of Waupun shall transfer title by quit claim deed, with no warranties of any kind. Any sale shall be final.
Buyer is responsible for costs of Title Insurance or other title evidence, Buyer closing costs, Recording Fees, and any real estate taxes due for the year of sale and outstanding special assessments.
Easements and restrictions of record may exist and the buyer must comply with all applicable codes and ordinances as outlined in Waupun Municipal Code.

CONVEYANCE; PAYMENT; CLOSING REQUIREMENTS
The City shall convey the Property to the successful bidder by Quit Claim Deed, together with a completed Wisconsin Real Estate Transfer Return receipt (evidence of filing). No earnest money shall be required.
Within TEN (10) calendar days following written notice of bid acceptance and governing body approval, the successful bidder shall remit the full purchase price by wire transfer of immediately available funds to an account designated in writing by the City. Upon timely receipt of the full purchase price and all required closing documentation, the City shall record the Quit Claim Deed and associated transfer documents. The successful bidder shall be responsible for all recording fees and filing costs associated with the transaction. Following recording, the City shall provide the bidder with the recorded Quit Claim Deed and Real Estate Transfer Return receipt.
Failure to Perform.
If the successful bidder fails to remit payment within the required TEN (10) day period, the City may, at its sole discretion and without notice: (a) declare the bid null and void and award the property to the next qualified bidder, without notice; (b) re-offer the property for sale by sealed bid or any other process; and/or (c) pursue any and all other remedies available at law or in equity, including without limitation, recovery of any deficiency between the defaulting bidder’s offer and any subsequent sale price.
Closing Documentation.
As a condition of closing, the successful bidder shall provide a properly completed and executed IRS Form W-9. The City reserves the right to require reasonable additional documentation necessary to complete the conveyance and comply with applicable law.
Governing Body Approval:
Any accepted bid and resulting Purchase Agreement shall be contingent upon approval by the City of Waupun Common Council at a properly noticed public meeting. The City shall have no obligation to proceed with the sale unless and until such approval is granted. In the event approval is not granted, the City shall have no liability to the bidder.
